1. Terms & Conditions 1.1 These terms and conditions apply as a condition of using any voucher, whether or not the voucher holder is the original purchaser. Please read the terms and conditions below before either carrying out a purchase or a booking. These terms apply notwithstanding anything contained in any quote, booking voucher or acceptance. No form of acceptance contrary to those terms will be effective alter the terms on which Weekendgetaways.co.nz have agreed to supply services.
2. Agency 2.1 Weekendgetawys.co.nz acts as a booking agent only. We sell activities and accommodation on behalf of numerous service providers. Weekendgetaways.co.nz obligation is to make bookings on your behalf and to arrange relevant contracts between you and service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not Weekendgetaways.co.nz. If for any reason, any service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with Weekendgetaways.co.nz.
3. General: 3.1 Once you have booked your package, you will be deemed to have accepted the service providers terms and conditions of trade. Details of any restrictions and cancellation fees will be included in your travel documentation or a link to the service providers website will be provided. Please pay particular attention to the clauses within the service providers terms and conditions relating to cancellation of bookings and limitations of liability.
3.2 You will be unable to access your accommodation, or gain entry to your activity or attraction without your voucher. If you lose your voucher a replacement voucher can be obtained from Weekendgetaways.co.nz no later than 48 hours prior to arrival. If any vouchers need to be couriered, this will be at your expense.
3.3 Each voucher will have a unique voucher number and a booking reference code. These numbers must be quoted when dealing with Weekendgetaways.co.nz and will be used to identify your booking. Vouchers and the associated reference numbers must be kept safely and securely. Weekendgetaways.co.nz will take no responsibility for any loss you may incur as a result of disclosure of the reference number impersonation or identity fraud.
3.4 The voucher(s) included in your travel documentation bear dates of validity for exchange for service(s). These dates clearly state when a voucher can be exchanged for a service. Weekendgetaways.co.nz takes no responsibility for any loss you may incur if these vouchers are attempted to be exchanged for service(s) outside the valid time frame.
3.5 A voucher is only valid for use on one occasion. Once a voucher has been exchanged for service(s) it is then deemed cancelled and can not be used again.
3.6 Packages are valid for dates of travel mentioned only, for travel outside of these dates please contact Weekendgetaways.co.nz.
3.7 Extra nights or services can be added to a package; however this would be done on a case to case basis and would need to therefore be re-quoted.
3.8 Please be aware that in most cases check in and check out times for accommodation providers can vary. You will find these times displayed on our website under each package, printed on your Travel Documentation, and printed on your Voucher(s).
3.9 All services are subject to availability. Where a certain date is unavailable we will endeavor to secure your next choice of dates, however this may not always be possible, especially in high and peak season. If we are unable to secure any of your preferred dates we will contact you to discuss it further.
3.10 Vouchers entitle the holder(s) to the services booked and mentioned on the voucher only. Any extra services/charges not booked through Weekendgetaways.co.nz are payable direct by the customer.
3.11 Any driving times and distances included in itineraries are given as a guideline only.
3.12 It is up to the voucher holder to re-confirm any bookings necessary direct with the service provider (These will be included in the itinerary along with a contact number). Weekendgetaways.co.nz will not be held responsible if a service is cancelled due to re-confirmation not being received by the service provider.
3.13 No flights are included in packages unless otherwise stated.
3.14 Weedendgetaways.co.nz will take all responsible steps to ensure all information in print material and itineraries is correct at time of printing.
3.15 Your travel package has been carefully planned and the documents have been double-checked, however, we strongly recommend that, if in the course of your travels, you do encounter a situation that is not to your satisfaction you take the matter up with the supplier of the service at the time or as soon as practicable in the circumstances. If you are still dissatisfied please contact Weekendgetaways.co.nz during business hours. This provides you the opportunity to have the matter discussed and investigated on the spot and a remedy negotiated then and there to enable you to enjoy your travel. If this is also not possible please do contact us promptly upon you return.
3.16 Weekendgetaways.co.nz will pass on any special requests to all operators but cannot be held responsible if the requests are not delivered.
3.17 Any travel/package bookings made through Weekendgetaways.co.nz must be done so by person 18 years old or over only. In making a booking you are implying and confirm that you are aged 18 years or over.
4. Payment: 4.1 Payment Options - We accept [ ] credit cards. Credit card transactions are handled by our secure server and charged once we have your services confirmed.
4.2 All packages must be prepaid.
4.3 Prices are per package, in New Zealand dollars, include GST currently at 12.5% and are subject to change up until time that full payment is received.
5. Cancellations: 5.1 Once a package is booked, you are subject to the refund and cancellation policy of the service provider responsible for offering that particular service. These will be outlined under each package on our website and on your Travel Documentation. Cancellation fees can be as much as the full amount of the package. We strongly recommend that you read the refund and cancellation policy details before accepting booking conditions. If you wish to cancel any services with Weekendgetaways.co.nz, you will need to contact us in writing as soon as possible. Each package on our website has it's own unique cancellation policy which can be found by clicking on the 'Click here for full details' link on each package page. If you wish to cancel part of a package you may be eligible for refund of this service if it is within the terms and conditions of the package. Any cancellations eligible for a refund will incur a $50.00NZD Weekendgetaways.co.nz amendment fee.
All cancellation must be in writing via email, fax or post. Weekendgetaways.co.nz's cancellation policy operates on a 10.00am - 10.00am schedule.
For example if the cancellation policy of your package is 24 hours prior to check in and your check in day is Wednesday at 2.00pm your cancellation must be received by Weekendgetaways.co.nz before 10.00am on Tuesday.
If the cancellation policy of your package is 48 hours prior to check in and your check in day is Wednesday at 2.00pm your cancellation must be received by Weekendgetaways.co.nz before 10.00am on Monday.
5.2 Occasionally, a service provider may have to change a booking date eg. if the activity is weather dependent. In these circumstances, the service provider will contact you directly as soon as possible to offer an alternative date. Should an alternative date be unavailable, you will be entitled to a full refund which will be processed only upon your completion of travel. Unfortunately, Weekendgetaways.co.nz will not be able to reimburse any traveling or other incidental expenses incurred.
5.3 It is recommended that you contact the service provider, by telephone, before you set out, to check the likelihood of a weather-related cancellation. The contact number for the service provider will be given to you after your booking is made and will included in all Travel Documentation and will be clearly printed on each respective voucher(s).
5.4 Activity/Attraction locations are added on a regular basis. In some instances, locations may occasionally be subject to change. If a location changes, we will do our very best to offer an alternative although in some cases this may not be possible.
5.5 The activity/attraction session lengths and running orders indicated are approximate not precise.
5.6 You are required to notify Weekendgetaways.co.nz of any relevant medical condition(s) at the time of booking.
5.7 Independent contracted operators supply the services offered by Weekendgetaways.co.nz. While we take every care in choosing our operators, we cannot guarantee the safety standards or satisfactory performance of any of them.
5.8 If a recipient's Weekendgetaways.co.nz Travel Documentation goes astray via email or in the post we will provide a duplicate free of charge.
5.9 Weekendgetaways.co.nz cannot be held liable for any loss suffered as a result of a Travel Documentation being lost in the normal express post mail process. Where Travel Documentation is delivered by email, Weekendgetaways.co.nz cannot be held liable for any loss suffered as a result of an email being lost in the normal mail process.
5.10 As detailed on the booking form or during any correspondence with Weekendgetaways.co.nz, you may be asked whether we may contact you after the experience for the purpose of feedback and customer care. This contact will take place only if you express your consent.
5.11 All the above terms and conditions apply as a condition of using any Travel Documentation and/or voucher(s), whether or not the voucher(s) holder is the original purchaser.
6. Limitation of Liability 6.1 Some activities/attractions are subject to restrictions regarding age, health or weight. Your Travel Documentation contains all restriction details and you are advised to read these as soon as possible or alternatively these details can be obtained directly from Weekendgetaways.co.nz on request.. If, at the sole discretion of the service provider, you are deemed unfit or unable to participate safely in all or any part of the purchased activity/attraction, the service provider reserves the right to withdraw you from the experience on the grounds of your own safety and that of others. In these circumstances, you will not be entitled to a refund or to re-book. Weekendgetaways.co.nz be not be liable to reimburse any travelling or other incidental expenses incurred. Details of restrictions are set out on the web site under each package component.
6.2 Participating in some activities/attractions may involve an element of risk; your package is purchased in the knowledge of this and Weekendgetaways.co.nz accepts no liability for any injury or any loss of any kind sustained or arising from participation in any activity. Weekendgetaways.co.nz can provide further information on any of our products if you are in doubt. However, ultimately the service providers have control of the activity/attraction on the day over which Weekendgetaways.co.nz has no influence. Whilst it is required for all operators to hold public liability and/or third party insurance you should make independent enquiries as to the need to acquire your own insurance cover.
7. Liability 7.1 We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense, or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control which is not preventable by reasonable diligence on our part.
8. Consumer Guarantees Act 8.1 You are a commercial customer if you acquire goods or services from us: (a) That are goods or services not ordinarily acquired for personal, domestic or household use; (b) For use in a business; or (c) For resale or supply to other persons in trade.
8.2 If you are a commercial customer and you onsell goods supplied by us to any customer who is not a "consumer" you agree to: (a) Contract out of the Consumer Guarantees Act in respect of the sale of the goods; and (b) Require your customer to contract out of the Consumer Guarantees Act in respect of any further sales of the goods (other than for sale to a consumer) and to require any sub-sellers to do the same.
8.3 You indemnify us for any damage or costs suffered as a result of your failure to comply with this clause. You are a consumer if you are not a commercial customer as defined above. If you are consumer, nothing in this document limits or excludes any right you have under the Consumer Guarantees Act 1993.
9. Governing Law 9.1 These terms of trade and all transactions between Weekendgetaways.co.nz and you will be governed by New Zealand Law and you submit to the jurisdiction of the New Zealand Courts.
10. 10.1 Any personal information obtained by Weekendgetaways.co.nz either through the booking form or Weekenders Club form will be used in the highest respect to the customer. Weekendgetaways.co.nz will not share any personal information provided to them except for usual business functions and for the purpose booking services. The Privacy Act many entitle you to access, and if necessary to request the correction of personal information we hold about you.
10.2 When you book your package, Weekendgetaways.co.nz will record your personal details, if these have not been previously submitted; these will be held and passed to the service provider of your service(s) for the purposes of administration and processing.
10.3 Weekendgetaways.co.nz may also ask you whether you wish to receive emails concerning other products and services offered by Weekendgetaways.co.nz as part of the "Weekenders Club". Such contact will only be sent if you give your express consent.
Making A Purchase Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.
We accept Visa and Mastercard credit card payment. You may also send your credit card information via phone, fax, snail mail or over the Internet.
When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you a booking confirmation. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Credit Card Security
When the order is placed at our website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.
